THE doctor who failed to spot that Baby P had a broken back two days before his death, is suing her former employers for unfair dismissal.

Dr Sabah Al-Zayyat examined Baby P - now known as Peter- at the child development clinic in Tottenham on August 1 2007. But she failed to notice that he had broken ribs and a broken back because she did not examine him properly.

Peter died two days later in his blood splattered cot in Tottenham after suffering months of sadistic abuse.

Dr Sabah Al-Zayyat missed the injuries after deciding Peter was "miserable and cranky, " and that she could not perform a full examination of him.

Great Ormond Street, which is responsible for child protection services in Haringey, terminated her contract after the case came to light.

But today (Friday June 19), it emerged that Dr Al-Zayyat was suing Great Ormond Street over her dismissal. It is understood that she believes she was made a scapegoat for wider failures in Haringey's child protection.

A spokesperson for Great Ormond Street said: "We didn't scapegoat her. The case surrounds her dismissal from GOSH following the decision not to renew her fixed term contract."

Baby Peter's mother, her boyfriend and their lodger Jason Owen, were all jailed for causing or allowing the 17-month-old boy's death last month.

Peter's mother and Owen were given indefinite sentences. She must serve at least five years and Owen at least three years.

The boyfriend was given a 12-year sentence for Peter's death and life for raping a two-year-old girl. He must serve a minimum of 10 years. This week, the 33-year-old man launched an appeal against both his convictions.

High Court Orders are in place, which prevent the Ham&High from identifying Peter's mother or her boyfriend.
