CROUCH End computer hacker Gary McKinnon's last-ditch plea to avoid extradition to America will be heard on May 25 and 26.
The judicial review will look at home secretary Alan Johnson's decision to extradite Mr McKinnon in the light of new medical evidence. The High Court will examine whether a US trial would breach his human rights.
The 43-year-old faces up to 60 years in a US jail for hacking into the country's military computer system. The Asperger's sufferer said he was looking for evidence of UFOs.
His stepfather Wilson Sharp said the family was pleased a date had been set but had hoped for a date during the election so politicians would talk about the case.
