CAMDEN Council is being taken to court over the death of a two-year-old crushed when a faulty wall collapsed during a storm.

Saurav Ghai, pictured right, died from multiple injuries after a 6ft by 8ft panel of the Wendling Estate's boundary wall was blown over by gales in Southampton Road, Gospel Oak, on January 18, 2007.

The Ham&High has learned the Health and Safety Executive, which has been investigating the incident for nearly two and a half years, is now launching a prosecution against the Town Hall.

The official court summons is expected to be delivered to council chiefs in the coming week.

Although the HSE is not commenting officially until the summons is served, sources have told the Ham&High the prosecution is in relation to the council's alleged failure to "maintain, repair and inspect" the defective wall.

A statement to the Ham&High from Camden Council said: "We confirm that the council has been informed the Health and Safety Executive plans to bring a prosecution under the Health and Safety at Work Act related to the tragic death of Saurav Ghai at the Wendling Estate in January 2007.

"The HSE has not yet provided any details of this proposed action to the council.

"Once we have received details of any proceedings we will consider them with our legal team."

At the end of the inquest into Saurav's death in November 2007, coroner Dr Andrew Reid said latent defects in the wall meant the tragedy was "an accident waiting to happen".

Saurav's family, who live on Parkhill Walk, Belsize Park, declined to comment about the case at this stage.
