Allan Young, 35, allegedly attacked his son Michael Winn in 1998 but the boy did not die until 2011.

He is now charged with manslaughter on the basis that the original injuries led to his son’s death.

The landmark case involves the longest period of time between injury and death since the common law “year and a day” rule was changed in 1996.

Young has not yet entered a plea but is set to stand trial at the Old Bailey on June 30.

He was jailed for 12 months in 1999 after pleading guilty to causing grievous bodily harm to his son.

Michael was given up for adoption and was living in Camden when he died on January 24, 2011.

Young was charged with manslaughter after the solicitor-general gave his consent to the prosecution.

Young, of Glasgow Road, Wishaw, Lanarkshire, is on conditional bail.
